Making a purchase

When you make a purchase through the ATYPIC Creation website, you are offering to buy Product(s) for the price stated, subject to these Terms.

All orders are subject to acceptance and availability.

Placing an Order

The Website contains an instructive guide that will walk you through the process of placing an order. You place your order for any selected items by clicking on the [Confirm Order] button at the end of the on-line order process.

Once you have placed your order, you will receive an email acknowledging the exact details of your order, providing you with a payment reference code and the value of your order that will be debited from your Payment card.

Please note that while the Website lists only available Product, there may be occasions due to circumstances beyond ATYPIC Creation’s control, where the Product is not available. In this case a latest delivery, where applicable, will be communicated to you or a credit note receipt equal to the value of any unavailable goods purchased shall be given to you.

Unless otherwise notified, ATYPIC Creation’s acceptance of your order occurs when you receive an email notifying you that we have dispatched the Product(s) as ordered by you and noted on that communication. Acceptance will be deemed to have occurred at the sending of this communication, regardless of technical problems you may experience, where the reasons are outside ATYPIC Creation’s control, which may result in you having not received that email in a timely manner.

Pricing Policy

At the ATYPIC Creation website you are given an opportunity to select your preferred currency. You may choose between US Dollar, Euro and UAE Dirham.

All currency priced items will be honoured as advertised unless it is obviously incorrect.

ATYPIC Creation offers our customers the “Free shipping charges” system, which means that you will not be charged for the items shipping cost BUT any import duty and tax fees to destination country shall be paid by you to the courier company at the time of delivery.

Product prices are set at the beginning of each season, using existing currency exchange rates. The rates are subject to variation and may go up or down; therefore prices are subject to change if the applicable currency exchange rate changes before your order is accepted or the items are markdown at any time during the selling period.

Payment

Payment will be debited and cleared from your account upon confirmation of your order from the ATYPIC Creation’s website.

You confirm that the Payment card that is being used is yours or that you have been specifically authorised by the owner of the Payment card to use it. All Payment card holders are subject to validation checks and authorisation by the card issuer.

If the issuer of your payment card refuses to authorise payment, ATYPIC Creation will not be liable for any delay or non-delivery.

The ATYPIC Creation website is fully secure and is protected by Verisign.

All Payment card transactions on the Website are processed using a secure online payment gateway that encrypts your card details in a secure host environment.

To help ensure that your shopping experience is safe, simple and reliable, the Website uses Secure Socket Layer (SSL) technology.

All reasonable care, as it is in ATYPIC Creation’s power to do so, to keep the details of your order and payment secure. In the absence of negligence on our part, ATYPIC Creation cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Returns

If a customer is not happy with their purchase they may obtain a full refund or exchange within 14 days of receipt of the goods. Satisfaction is always a top priority and as such each query is addressed individually to the best of our ability.

Your refund will be made through a Credit Note System and will exclude shipping costs which we deduct to cover the cost of our collection service. The credit note system refers to our policy of giving you a receipt equal to the value of the goods purchased less the related shipping costs, duties and taxes to cover the collection service charges.

Customs duties and sales taxes are non-refundable. Please note that exchanges will be submitted through the same customs procedures, therefore are applicable for duty and tax again. Hence, we encourage you to please make sure of your purchases to avoid unnecessary purchase returns and exchanges.

Please be aware that in order to receive a refund or exchange, the item(s) must be unworn and in perfect condition, with all the labels attached and in the original packaging. Where provided, any designer packaging such as authenticity cards, dust bags and leather tags should be included as part of your return. We will not accept returns that do not adhere to the specified conditions outlined.

Briefs, swimming costumes and bikini bottoms should be tried on over underwear. Returns may not be accepted if the protection strip has been removed (swimming wear) or if the items are soiled (lingerie) and will be returned to you.

All returns should be sent back in their original packaging provided. Please ensure when returning the parcel that the packaging is properly protected.

Exchanges

In order to exchange products, requested for the exchange must be of the same value or higher. We will not exchange products for lower value than the original item purchased.

Please contact contact@atypiccreation.com who will issue you with a RAN (Return Authorisation Number). In doing so, please specify the product information you require and we will process this for you. You will receive confirmation of your exchange within 48 hours.

Customs duties and sales taxes are non-refundable through ATYPIC Creation. Please note that exchanges will be submitted through the same customs procedures, therefore are applicable for duty and tax again.

Gift returns

If you have received an item from ATYPIC Creation as a gift, you can exchange it for another item of the same value, but must pay the additional shipping, taxes, import duties and any additional charges which may incur as a result of the exchange.

Passing of property and risk

ATYPIC Creation retains legal ownership of the Product(s) until full payment has been made and such payment has been received. Legal ownership of the Product(s) will immediately revert to ATYPIC Creation, if payment is refunded to you.

Risk on the Product(s) will pass to you upon delivery.
